Buffalo Domestic Violence Lawyer Discusses if a 911 Call can Determine a Criminal Case

Charged for a crime? Read this article where our Buffalo domestic violence lawyer discusses if a 911 call can determine a criminal case.

Question:

If a person calls 911 making a allegation of abuse, is that sufficient in a criminal case if there is no wounds or marks on the person when the police arrive? Can the person bring up something like attempted assault to make a case go to trial based on the 911 call if the other party is arrested?

Answer:

I have advised clients that the 911 call may be used but you would need some corroborating evidence of a physical injury, and that the person allegedly injured is in fact the complainant.
