Buffalo Criminal Defense Attorney Discusses If a Landlord Can be Charged for a Renter’s Crime

Question:

An apartment I sublet was recently searched and illegal guns were found. I’m not sure if being the original tenant will get me in trouble. My LLC is also registered to this address. How do these charges affect me and my business? The guns don’t belong to me at all.

Answer:

I have advised previous clients that the prosecution has to show actual or constructive possession of the weapon. If you don’t reside there and there is no evidence that you possess dominion and control over the premises it is difficult to prove you have any ties to the weapon. However, as a Buffalo Criminal Defense Attorney I will advise clients that any clothes of yours or mail in your name could be damaging if found in the apartment.
