As an experienced Orchard Park DWI Lawyer I am often asked about sobriety tests.  Recently, I was representing a client in Orchard Park. She had been arrested and charged with a DWI. She wanted to know if it was okay not to take the roadside field sobriety test. These usually involve four or five physical tests that the officer asks you to perform while on the side of the road. What they don’t tell you is you are under no obligation to take these tests. You can take and refuse these tests without any penalty. My advice is always to refuse to take any roadside field sobriety tests.
