As an experienced Buffalo DWI Attorney I am regularly asked what will happen to a DWI offense if there was an accident involved.  According to the NYS DMV, they recently recorded 8,461 alcohol related car accidents in a single year. If you get into an accident while driving while intoxicated either by alcohol or drugs, one of the most important pieces of advice I give is not to flee the scene. If you flee the scene of an accident caused by drunk driving, additional charges will be added. It’s best to call 911 immediately, make sure no one is hurt, cooperate with the police as far as giving them your name, and your address. As always, you do not have to tell them how much you had to drink, you do not have to perform any roadside field sobriety tests, nor do you have to take a breathalyzer test or chemical test back at the station. You can politely tell them that you have the right to remain silent, and would like to speak to an attorney.
